Terms & Conditions
VIP TOURS AU PTY LTD. – Terms & Conditions
These Terms and Conditions govern all bookings with VIP TOURS AU PTY LTD (“VIP TOURS AU”, “we”, “our”, “us”). By confirming a booking and/or participating in any of our tours, the client (“you”, “passenger”, “group”, or “participant”) agrees to be bound by the following:
Acceptance of Booking & Payments
A booking is confirmed when VIP TOURS AU issues a written confirmation. Full payment is required prior to the date of travel. Failure to pay on time may result in cancellation without refund. Payments are non-transferable unless otherwise agreed in writing.
Contractual Relationship
By making a booking, you enter into a contract with VIP TOURS AU. The contract is limited strictly to the services outlined in the confirmation invoice. Any extras, third-party services, or deviations are the sole responsibility of the passenger.
Passenger Responsibility & Assumption of Risk
All passengers travel entirely at their own risk. Participation in tours involves inherent risks such as road conditions, weather, wildlife encounters, and unforeseen events. VIP TOURS AU accepts no responsibility for personal injury, illness, property damage, or death during or after the tour.
Subcontractors & Third-Party Services
We may subcontract transport, accommodation, or activities. Passengers must comply with subcontractors’ terms and are directly responsible for damages, fines, or misconduct while using such services. VIP TOURS AU is not liable for acts, omissions, or negligence of subcontractors.
Insurance Obligations
VIP TOURS AU holds Public Liability insurance (up to AUD $20 million) strictly covering company negligence. This insurance does not cover passengers personally. Passengers are strongly advised and expected to hold personal travel/health insurance covering medical emergencies, cancellation, loss of belongings, and liability for damages.
Health, Fitness & Medical Conditions
Passengers must be fit to travel and disclose any relevant medical conditions at the time of booking. Passengers are solely responsible for carrying personal medications and treatments. VIP TOURS AU will not provide refunds for missed activities due to medical conditions.
Alcohol, Drugs & Misconduct
Consumption of alcohol is prohibited on board unless expressly authorised. Illegal substances are strictly forbidden. Any passenger under the influence or behaving in a way that risks safety may be denied boarding or removed from the tour without refund.
Behaviour & Group Safety
Passengers must respect others, staff, and local communities. Abusive, aggressive, or disruptive behaviour will result in immediate removal without refund. Guides have full authority to enforce safety and conduct rules.
Damage & Cleaning
Passengers are liable for any damage they cause to vehicles, property, or facilities. Excessive cleaning fees (vomiting, spills, vandalism, etc.) will be charged directly to the passenger. Any costs passed to VIP TOURS AU by subcontractors will be recovered from the responsible passenger.
Responsibility for Fines & Sanctions
Any fines, penalties, or sanctions (police intervention, traffic offences, misconduct) resulting from passenger behaviour are the responsibility of the passenger or group leader. VIP TOURS AU is not liable for paying or contesting such fines.
Itinerary & Service Changes
VIP TOURS AU reserves the right to alter itineraries, departure/arrival times, or destinations due to weather, road closures, safety concerns, or operational reasons. Refunds will not be issued for changes outside our control.
Force Majeure
In case of natural disasters, extreme weather, strikes, pandemics, or restrictions, tours may be cancelled or modified. Options may include credits, rescheduling, or partial refunds (less unrecoverable costs). VIP TOURS AU is not liable for incidental costs such as flights or visas.
Cancellations by Passenger
Cancellations must be in writing. Within 7 days of departure: 25% cancellation fee. Within 24 hours or no-show: 100% forfeited. Medical emergencies supported by a certificate may receive credit for future tours.
➤ Additional Clause: If a passenger chooses to cancel their booking at any time, a non-refundable administrative fee of AUD $50 will be withheld from the total amount paid.
Cancellations by VIP TOURS AU
If VIP TOURS AU cancels a tour, passengers may receive a credit or refund. Refunds are limited to amounts paid and exclude incidental costs.
➤ Additional Clause: If a trip must be rescheduled due to weather conditions or if fewer than 15 students purchase the package, passengers will be offered an alternative date. Should the passenger decide not to attend on the new date, the refund will exclude a non-refundable administrative fee of AUD $50.
Conduct of Minors
All passengers under 18 must be accompanied by a responsible adult. Parents or guardians bear full responsibility for the safety, supervision, and conduct of minors.
Lost or Stolen Property
VIP TOURS AU is not responsible for lost, stolen, or damaged belongings. Passengers are encouraged to safeguard personal items at all times.
Acceptance of Risk
Travel in Australia may involve exposure to dangerous wildlife, rugged environments, and extreme weather. By joining a tour, passengers voluntarily accept these risks. VIP TOURS AU bears no responsibility for injuries or incidents arising from natural hazards.
Authority on Tour
The driver or guide is the group leader. All passengers must follow instructions from the leader at all times. Refusal to comply may result in immediate removal without refund.
Limitation of Liability
To the fullest extent permitted by law, VIP TOURS AU disclaims all liability for injury, loss, damage, delay, inconvenience, or death. We do not guarantee specific outcomes such as wildlife sightings or weather conditions.
Governing Law
These Terms & Conditions are governed by the laws of Victoria, Australia. Any disputes shall be resolved exclusively in the courts of Victoria.
